The court in Russia for the first time considered the case of the Ukrainian prisoner of war

On March 29, 2022, a citizen of Ukraine, Nikita Shkryabin, was deprived of liberty by servicemen of the Russian Ministry of Defense during hostilities. Since then, it has been at the disposal of the RF Ministry of Defense in an unspecified location.

Shkryabin’s Russian lawyer Leonid Solovyov in August of this year received confirmation of his imprisonment “in connection with the opposition to a special military operation.” The whereabouts of Shkryabin, as well as the procedural grounds for his detention, were not communicated to the lawyer with reference to “restricted information”. His visit to the lawyer was expressly denied. The Ministry of Defense does not recognize Shkryabin as prisoners of war.

The lawyer applied to the military investigation department of the TFR with a statement about the crime of unidentified servicemen of the Russian army, who for a long time kept his client incommunicado. The TFR refused to conduct an audit.

The lawyer filed a complaint with the garrison military court, which today recognized the inaction of the military investigation as lawful. The court found:

Therefore, he does not have any procedural rights, including to a lawyer.

In total, according to various estimates, there are several thousand captive citizens of Ukraine in isolation. The location of most of them is unknown. The Ministry of Defense of the Russian Federation, at the request of Russian lawyers, confirms the fact of detaining specific individuals, and also reports on the state of health. Information about the specific location is not reported and access to them is prohibited.
